Am-Can Business & Tech Institute (the School, we, us, or our) is operated by AM-CAN BUSINESS & LMS SERVICES MANAGEMENT LTD. We are registered as a private secondary school with the Ontario Ministry of Education. As part of our commitment to academic excellence, student support, and regulatory compliance, we have established this Privacy Policy to govern the collection, use, disclosure, and safekeeping of personal information.

This Privacy Policy is designed to comply with the federal Personal Information Protection and Electronic Documents Act (PIPEDA), the provincial Freedom of Information and Protection of Privacy Act (FIPPA), the Municipal Freedom of Information and Protection of Privacy Act (MFIPPA) where applicable, and the Ontario Ministry of Education’s Ontario Student Record (OSR) Guideline.

Part 1: Website Privacy Policy

1. Our Ten Privacy Principles (CSA Code & PIPEDA Compliance)

In alignment with the Canadian Standards Association (CSA) Model Code for the Protection of Personal Information, we adhere to the following ten principles:

  • Accountability: We are responsible for personal information under our control. Our designated Privacy Officer is Muhammad A. Watto, Director of AM-CAN BUSINESS & LMS SERVICES MANAGEMENT LTD.

  • Identifying Purposes: The purposes for which personal information is collected will be identified at or before the time of collection.

  • Consent: We obtain appropriate, documented consent from the student (if they are an adult) or the parent/legal guardian (if the student is under 18) for the collection, use, or disclosure of personal information, except where permitted or required by law.

  • Limiting Collection: We only collect personal information that is reasonably necessary for school registration, academic evaluation, OSR management, and secure platform access.

  • Limiting Use, Disclosure, and Retention: Personal information will not be used or disclosed for purposes other than those for which it was collected, except with consent or as required by law. Information is retained in accordance with provincial storage schedules.

  • Accuracy: Personal information will be kept as accurate, complete, and up-to-date as is necessary for the purposes for which it is used.

  • Safeguards: Personal information is protected by physical, organizational, and technological security measures appropriate to the sensitivity of the information.

  • Openness: We make specific information about our policies and practices relating to the management of personal information readily available.

  • Individual Access: Upon written request, students and authorized parents will be informed of the existence, use, and disclosure of their personal information and will be given access to that information.

  • Challenging Compliance: Individuals may address a challenge concerning compliance with these principles to our Privacy Officer.

2. Information We Collect

We collect personal information about students, parents, and website users through registration forms, prerequisite waiver requests, email correspondence, and our electronic Learning Management System (e-LMS) portal. This includes:

  • Biographical Data: Full legal name, date of birth, gender, home address, phone number, and personal email address.

  • Identification Numbers: Ontario Education Number (OEN) and Ministry Identification Number (MIN) where applicable.

  • Academic Records: Prior school transcripts, report cards, course completion records, prerequisite waiver submissions, and instructor feedback logs.

  • Custody & Legal Documentation: Custody orders, legal guardianship papers, or name-change certificates (stored in the physical OSR documentation file).

  • Technical Data: IP addresses, login credentials, and usage logs from our e-LMS platform to monitor secure access and complete required statistical reporting.

3. How We Use Your Information

We use personal information to:

  • Establish and administer student registrations, prerequisite waivers, and course enrollments.

  • Maintain, transfer, and securely archive the Ontario Student Record (OSR) and generate official Ontario Student Transcripts (OST) in compliance with the Education Act.

  • Grant secure, authenticated access to our e-LMS asynchronous learning platform.

  • Conduct fair and transparent student assessments and report mid-term and final grades in alignment with the Growing Success guideline.

  • Compile and submit compulsory statistical reports on enrollment, courses, and staffing three times per year to the Ministry of Education via OnSIS.

  • Coordinate university applications with the Ontario Universities’ Application Centre (OUAC) for eligible students.

4. Security and Safeguarding of Information

We employ strict administrative, physical, and technical measures to protect your data:

  • Physical Records: Current OSR folders and documentation files are maintained in locked storage in a designated central area of our Vaughan campus (Unit B, 99 Sante Dr.). Access is restricted solely to the Principal, authorized teachers, and delegated administrative staff.

  • Technological Security: All digital records are stored on a secure, closed internal managed network. In compliance with Ministry security protocols, school administrators only access the OEN and OnSIS applications from physical school computers within our secure managed network. Remote access of any kind to OEN and OnSIS database entries is strictly prohibited.

  • Password Protocols: Users are assigned personal, secure credentials. GO Secure and e-LMS passwords must never be shared or disclosed. Suspected password compromises must be reported immediately to our IT Support Desk at admissions@amcantech.org.

5. OSR Access and the Age of Majority (18 Years)

The management of student privacy changes when a student reaches the age of majority in Ontario (18 years):

  • Under 18 Years: Both the student and their parents or legal guardians have a legal right under the Education Act to examine the OSR contents and receive copies of report cards.

  • 18 Years and Older: When a student turns 18, they are legally considered an adult. Under FIPPA, the school must obtain the student’s explicit, written consent before sharing any personal information, attendance reports, academic assessments, or report cards with their parents or guardians.

  • Supervised Examination: Any authorized student or parent wishing to view an OSR must schedule an appointment with the Principal’s office. Examination of the record must take place under the direct supervision of the Principal or an authorized delegate to ensure record security and accurate interpretation.

6. OSR Transfer Policies

Original Ontario Student Records are legal documents and are subject to strict transfer regulations:

  • Within Ontario: Upon receipt of an official written request from the principal of another inspected Ontario school, the original OSR will be transferred securely via a commercial courier service with tracking enabled. No OSR is ever transferred by fax.

  • Out of Ontario: Original OSR folders must never be sent or transferred outside of Ontario. If a student transfers to a school outside Ontario, we will provide an exact, certified photocopy of the OSR only, upon receiving written requests from both the receiving school and the parents (or adult student). The original OSR remains stored securely in our archives.

7. Retention and Destruction Schedules

We retain student records in accordance with the provincial Freedom of Information laws:

  • One Year After Use: Personal information, general correspondence, and completed evaluation instruments are held for at least one year.

  • Five Years After Retirement: Report cards, documentation files (including special instructional arrangements or prerequisite waivers), and third-party diagnostic reports are retained in the OSR folder for five years after the student retires from the school.

  • Fifty-Five Years After Retirement: The physical OSR folder, the official Ontario Student Transcript (OST), and the associated Office Index Card are stored securely in our central archive for 55 years after retirement, after which they are destroyed completely and confidentially under written authorization.

Part 2: Website & LMS Terms of Use

Welcome to the website of Am-Can Business & Tech Institute (the School). These Terms of Use (Terms) govern your access to and use of our public website (amcantech.org), our school services, and our asynchronous electronic Learning Management System (e-LMS) portal.

By registering for courses, accessing our learning platform, or using this website, you agree to be bound by these Terms and our Privacy Policy. If you do not agree with any part of these Terms, please do not use our site or portal.

1. Corporate Ownership

The School is owned and operated by AM-CAN BUSINESS & LMS SERVICES MANAGEMENT LTD. All agreements, tuition invoices, registrations, and official transactions are fully managed under this corporate entity.

2. Access and Acceptable Use of Technology

Students are granted a personal, non-transferable, and revocable license to access our asynchronous e-LMS platform for the sole purpose of completing registered high school courses. Users agree that they will not use our network or platforms to:

  • Create, store, or transmit any offensive, obscene, defamatory, indecent, or abusive material.

  • Transmit unsolicited commercial advertisements or spam.

  • Attempt to gain unauthorized access to our databases, or disrupt e-LMS operations.

  • Violate the privacy of other students, teachers, or administrators online.

  • Knowingly introduce viruses, malware, or corrupted data.

  • Copy, distribute, or infringe upon the copyright of any educational materials, lesson videos, or school course designs provided on the site or LMS.

3. Academic Integrity, Cheating, and Plagiarism

We hold our students to the highest standards of academic honesty in accordance with the Ministry of Education’s Growing Success guideline:

  • Original Work: All assignments, assessments, and projects submitted to our instructors must represent the student’s own original work.

  • Definition of Plagiarism: Plagiarism is defined as the use or close imitation of the language, ideas, and thoughts of another person or source without proper attribution, in order to represent them as one’s own.

  • Prohibited Activities: Students must not participate in cheating, use unauthorized aids on tests, submit assignments completed by tutors or third parties, or falsely represent their identity during exams.

  • Proctored Exams: All final examinations must be written under the supervision of an approved, independent, professional proctor (such as an Ontario Certified Teacher, librarian, counselor, or physician) who has been verified by our administrative office. Relative proctors or paid personal tutors will not be approved.

  • Academic Consequences: If a student is found to have cheated or plagiarized, they will face progressive disciplinary action. Consequences may include a grade of zero on the assessment, parent consultation, or suspension/expulsion from the course without a refund, at the discretion of the Principal.

4. Full Disclosure and Course Withdrawal Policy

For Grades 11 and 12, we strictly enforce the Ministry of Education’s Full Disclosure policy:

  • Exemption: Course withdrawals at the Grade 9 and 10 levels are completely exempt from full disclosure and will never appear on the transcript.

  • Grade 11 & 12 Drops: If a student withdraws from a Grade 11 or 12 course within five (5) instructional days after the issuance of the official midterm report card, the course is removed from their record and will not appear on their transcript.

  • Full Disclosure Penalty: If a student drops a Grade 11 or 12 course five (5) or more days after the issuance of the midterm report card, the withdrawal is recorded permanently on the Ontario Student Transcript (OST) with a notation of ‘W’ and the student’s grade at the time of withdrawal.

5. Tuition and Fee Policies

All tuition fees, prerequisite waiver fees, and administrative charges are established by AM-CAN BUSINESS & LMS SERVICES MANAGEMENT LTD.:

  • Tuition Payment: Fees must be paid in full prior to the student gaining access to course materials on the e-LMS platform.

  • Certified Cheques and Money Orders: All certified cheques or money orders must be made payable to AM-CAN BUSINESS & LMS SERVICES MANAGEMENT LTD. and mailed to our corporate mailing address: Unit A, 99 Sante Dr., Vaughan, Ontario, L4K 3C4. Please ensure the student’s name and school name are clearly written on the back of the payment.

  • Course Transfer Fee: Changing enrollment from one course to another is subject to a $100 CAD course transfer fee, and the student must start the new course from the beginning.

  • Course Extensions: High school courses are designed to be completed within 12 months. Pacing extensions may be requested for a fee of $125 CAD per 3-month extension.

  • Refund Policy: Once registration is processed and e-LMS credentials are issued, refunds are only considered within 7 days of enrollment, provided that no significant teacher engagement or course progression has occurred. Refund requests must be sent in writing to Admissions@amcantech.org.

6. Limitation of Liability

Am-Can Business & Tech Institute and AM-CAN BUSINESS & LMS SERVICES MANAGEMENT LTD. make every effort to maintain continuous, uninterrupted access to our website and e-LMS portal. However, we do not guarantee that our services will be completely free of technical interruptions, platform downtime, or data transmission delays caused by third-party hosting networks, internet outages, or student software incompatibilities. The School is not liable for any indirect or consequential damages arising from technical interruptions on student-owned equipment.

7. Governing Law

These Terms and your use of our website and services are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada. Any legal disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Ontario.
